Abstract

This study examines the criminal liability of perpetrators of Domestic Violence (DV) and the effectiveness of legal protection for victims under the PKDRT Law and the PSK Law. Using normative legal methods with a statutory and conceptual approach, this study analyzes the gap between das Sollen and das Sein. The results show that the PKDRT Law has succeeded in changing the paradigm of domestic violence into a public crime with tiered sanctions that complement the victim's right to recovery and restitution. However, its implementation is hampered by three dimensions: structural obstacles (police bureaucracy and the lack of UPTD PPA), cultural (patriarchal culture and apparatus bias), and substantial (integration of restitution). In conclusion, resolving domestic violence requires synergistic institutional reform, gender-based cultural overhaul, and a holistic recovery approach to balance perpetrator punishment with comprehensive victim protection.
